Holding
The Court held that anticipatory bail should be granted to the petitioners.
Summary
The petitioners Amit Shrivastava, Shah Alam and Neeraj Sharma were implicated in a FIR (Siwan Town PS Case No.526 of 2025) for alleged forgery of a sale deed concerning land. The prosecution alleged that they forged signatures to execute a sale deed dated 30‑05‑2025, while the petitioners contended that they merely acted as deed writer, identifier and witness for a bona‑fide sale deed dated 05‑06‑2025 after full payment had been received. They applied for anticipatory bail, asserting innocence and clean antecedents. The State opposed the bail but did not dispute the factual matrix presented by the petitioners. Considering the existence of a legitimate sale deed and the petitioners’ role, the Court inclined to grant anticipatory bail subject to conditions under Section 438 of the CrPC and Section 482 of the Bhartiya Nagarik Suraksha Sanhita.
Issues considered
- Whether the petitioners are entitled to anticipatory bail under Section 438 of the Code of Criminal Procedure and Section 482 of the Bhartiya Nagarik Suraksha Sanhita in view of the alleged forgery charges.
- Whether the existence of a bona‑fide sale deed negates the ground for denial of bail.
- Whether the petitioners’ alleged role as deed writer, identifier and witness justifies the grant of anticipatory bail.
