Suraj Kumar GuptaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that the petitioner is entitled to bail as the evidence does not substantiate the alleged kidnapping.

Summary

Suraj Kumar Gupta, a 21‑year‑old, was arrested in connection with an alleged kidnapping of an informant’s daughter under Sections 96, 351(3) and 3(5) of the BNS. The prosecution claimed he abducted the girl, while the petitioner asserted that he was falsely implicated and that the victim’s own statement under Section 183 BNSS indicated she had gone voluntarily to a friend’s house. The petitioner, who had been in custody since 4 January 2025 and had no prior criminal record, applied for bail. The State opposed the bail application. The Court examined the FIR, case diary, the impugned order dated 25 June 2025 and the victim’s statement, finding no allegation of abduction or sexual assault against the petitioner. Consequently, the Court ordered his release on bail upon furnishing a bond of Rs 10,000 with two sureties.
