Provisional anticipatory bail is granted subject to conditions and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Bishnu Kumar Singh, applied for anticipatory bail fearing arrest in a case registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018 concerning alleged recovery of 100 litres of liquor from the premises of Akhilesh Kumar. He contended that he was not arrested on the spot, had no possession of the liquor, and had no relationship with the alleged owner, asserting that the complaint was motivated by an inimical relationship with the watchman. The State opposed the bail application. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.5,000 with two sureties and compliance with the conditions of Section 438(2) of the Cr.P.C. and Section 482(2) of the BNSS. The order further directed the trial court to verify the petitioner’s criminal antecedent and conditionally confirm the bail if only one prior case is found, otherwise the bail would not be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438(2) Cr.P.C. in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018
  • Whether the petitioner’s alleged criminal antecedent affects the confirmation of anticipatory bail
