Patna High Court

Suresh Das @ Suresh Kumar DasversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The Court denied bail to the petitioner, finding the allegations serious enough to warrant continued custody.

Summary

The petitioner, Suresh Das, was arrested in connection with a dowry‑death case where the informant's daughter was allegedly killed for non‑payment of dowry and her body dumped near a river. He applied for regular bail, claiming innocence and that he is the husband of the deceased. The State opposed, emphasizing his specific accusation in the FIR for the murder. The Court, considering the gravity of the offences under Sections 103(1), 80(2), 238 and 3(5) of the Bharatiya Nyaya Sanhita and the circumstances of the death, rejected the bail application. However, the Court directed the trial court to expedite the trial and conclude it within a year of receiving the order.

                                       ORAL ORDER

2 16-02-2026 Heard learned counsel for the petitioner and learned

                   A.P.P. for the State.

                                2. Petitioner seeks regular bail in connection with

Supaul Nadi P. S. Case No. 68 of 2025 registered for the

                   offences punishable under Sections 103(1) 80(2), 238, 3(5) of

                   the Bharatiya Nyaya Sanhita.

                                3. As per F.I.R., daughter of the informant was killed

due to non-fulfillment of demand of dowry by the named

accused persons, including this petitioner, and her dead body

                   was dumped near Tilyuga river.

                                4. Learned counsel for the petitioner submits that

petitioner is husband of the deceased. Petitioner is innocent and

has falsely been implicated in this case. Petitioner is in custody

                   since 04.06.2025.
Patna High Court CR. MISC. No.7409 of 2026(2) dt.16-02-2026
                                                          2/2

                                     5. Learned A.P.P. for the State vehemently opposed

the bail application and submitted that petitioner is named in the

F.I.R. with specific accusation that he along with other accused

persons killed the daughter of informant.

                                     6. Considering the nature of accusation and gravity of

the offence and the fact that deceased died in her matrimonial

house in unnatural circumstances within seven years of

marriage, prayer for bail of the petitioner is rejected.

                                     7. However, since petitioner is in custody since

04.06.2025, Trial Court is directed to expedite and conclude the

trial, preferably, within a period of one year from the date of

receipt/production of copy of this order.
