Holding

The Court granted provisional anticipatory bail subject to conditions and verification of the petitioner’s antecedent.

Summary

Lakhan Kumar Sahni applied for anticipatory bail after learning that he may be arrested in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 for allegedly possessing 40 litres of liquor recovered from a motorcycle. He asserted that he has a clean criminal record, was not arrested on the spot, did not have conscious possession of the liquor, and is not the owner of the vehicle. The State opposed the bail. The Court, considering the submissions, granted provisional anticipatory bail on the condition of furnishing bail bonds and sureties, subject to verification of the petitioner’s antecedent by the trial court. If any prior case is discovered, the bail may be revoked; otherwise, it will be confirmed. The order was made under Section 438(2) of the Cr.P.C. and Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 Cr.P.C. and Section 482(2) BNSS in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
  • Whether the petitioner’s claim of a clean antecedent affects the grant of anticipatory bail.

                                2. The petitioner apprehends his arrest in a case registered

for the offence punishable under Section 30(a) of the Bihar

                                3. Learned counsel for the petitioner submits that

petitioner is a person with clean antecedent and allegation is of

petitioner was not arrested from the spot, as such, nothing was

petitioner is not the owner of the seized vehicle and came to be

implicated based on the secret information which is the easiest way

to implicate someone without holding a proper investigation, when

petitioner admittedly is a person with clean antecedent.

                                  7. It is made clear that thereafter the learned trial court
