Provisional anticipatory bail is granted subject to verification of the petitioner's antecedent; it will be confirmed if the antecedent is clean and otherwise withdrawn.

Summary

The petitioner, Ashok Singh, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act for the alleged recovery of 279 litres of liquor from a vehicle. He asserted a clean criminal record, denied ownership of the seized vehicle, and claimed he was falsely implicated by a chowkidar. The State opposed the bail. The Court, applying Section 438(2) of the Criminal Procedure Code, directed provisional bail on the condition of furnishing bail bonds and two sureties, pending verification of the petitioner's antecedent by the trial court. The order stipulated that if any prior case is found, the bail would not be confirmed; if the antecedent is clean, the bail would be confirmed forthwith. Thus, the petitioner's anticipatory bail was granted conditionally.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 Cr.P.C. in a case arising under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the petitioner's claim of clean antecedent and lack of possession of the seized liquor justify the grant of bail.
  • Whether the trial court's verification of the petitioner's criminal antecedent can affect the confirmation of the provisional bail.

                   learned APP for the State.

                                2. The petitioner apprehends his arrest in a case

                   Bihar Prohibition and Excise Act.

                                3. The learned counsel for the petitioner submits that

the petitioner is a person with clean antecedent and allegation is

                                4. It is next submitted that petitioner was not arrested

from the spot as such nothing was recovered from his conscious

possession and is not the owner of the seized vehicle and he

came to be implicated at the instance of Chowkidar but then it is

police prior to institution of the instant FIR which casts an

aspersion on the case of the prosecution. It is next submitted that

it appears that the Chowkidar in order to save the real culprits

          falsely implicated the petitioner.

                       5. The learned APP for the State opposes the

          anticipatory bail application.

                       6. Considering the submissions made by the learned

counsel for the petitioner, the petitioner above-named, in the

event of his arrest or surrender before the learned Court below

within a period of six weeks, is directed to be released on

provisional bail on his furnishing bail-bonds in the sum of

Rs.500/- (Rupees Five Hundred) with two sureties of the like

amount each to the satisfaction of the learned Additional

Sessions Judge-XIII-CumSpecial Judge, Excise-I, Gopalganj in

conditions laid down under Section 438(2) of the Cr.P.C.

                       7. It is made clear that the learned trial court thereafter

shall verify the criminal antecedent of the petitioner and in the

event if it is found that petitioner has antecedent of even one

case, in that event, it would be presumed that petitioner had
