Holding
The court held that pre‑arrest bail could not be granted due to the seriousness of the alleged offences and the petitioner’s alleged participation.
Summary
Rubi Devi, the petitioner, filed a pre‑arrest bail application in a criminal case (No. 218 of 2024) where she is alleged to have participated in a knife assault that caused the death of the informant's father, offences charged under sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita. The court examined the seriousness of the allegations, the nature of the offence and the surrounding circumstances. Considering the gravity of the charges and the alleged involvement of the petitioner as an assailant, the court found no sufficient ground to grant bail before arrest.
