Patna High Court

Vakil YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Yadav, was arrested in connection with the alleged kidnapping and murder of a woman’s son and charged under Sections 140(1) and 3(5) of the Bharatiya Nyaya Sanhita. He filed an application for regular bail, asserting his innocence and contending that the informant was not an eyewitness and that no direct or indirect material linked him to the offence. The State opposed the bail application. The court considered the nature of the accusation, the absence of substantive evidence, and the length of the petitioner’s custody since 10‑03‑2025. Concluding that only suspicion existed without material proof, the court granted bail on the condition of a Rs.10,000 bond with two sureties. The petitioner was directed to be released.

Issues considered

  • Whether regular bail should be granted to an accused under Sections 140(1) and 3(5) of the Bharatiya Nyaya Sanhita when only suspicion exists.
  • Whether the lack of direct or indirect material evidence justifies denial of bail.
