BAIL GRANTED

Holding

The High Court allowed the anticipatory bail application, granting bail subject to the conditions prescribed under Section 482(2) of the CrPC.

Summary

The petitioner, Arvind Singh, applied for anticipatory bail after being implicated in a robbery case registered under Section 392 of the Indian Penal Code. He asserted that he was not present at the scene of the alleged crime, which occurred on 15 September 2023, and that the motorcycle seized by police was registered in his name but was being used by his son. He provided a supplementary affidavit showing his residence and employment in Kolkata for the past 15‑20 years, arguing that he has no intention to abscond and will cooperate with the investigation. The State opposed the bail, but the High Court, after considering the affidavit and the petitioner's clean antecedents, ordered that he be released on anticipatory bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the CrPC. The application for anticipatory bail was therefore allowed.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner under Section 482(2) of the CrPC in a case registered under Section 392 IPC.
  • Whether the registration of the motorcycle in the petitioner's name suffices to implicate him in the alleged robbery.
