Patna High Court

Nandlal KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail should be granted to the petitioner.

Summary

The petitioner, Nandlal Kumar, was arrested in connection with a robbery alleged under Section 309(6) of the Bharatiya Nyaya Sanhita, 2023, where three miscreants allegedly snatched a bag containing Rs. 55,186 and documents. The petitioner contended that he was falsely implicated, not named in the FIR, and was arrested solely on a self‑confession that lacks evidentiary value, with no incriminating material recovered from his possession. He also highlighted his clean record and that a co‑accused had already been granted regular bail. The State opposed bail, but the Court, considering the lack of material evidence, the questionable basis of the confession, and the period of custody already served, decided to grant bail. The petitioner was ordered to be released on a bail bond of Rs. 15,000 with two sureties of the same amount.

Issues considered

  • Whether the petitioner is entitled to bail despite the charge under Section 309(6) of the Bharatiya Nyaya Sanhita, 2023.
  • Whether a self‑confession made before police, without corroborating material, can justify continued detention.
  • Whether the absence of recovered incriminating articles and the petitioner's clean antecedent warrant bail.
