Patna High Court

Ankit Kumar @ Dipu Kumar @ AnkitversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was refused as the confessional statement of the co-accused indicated the petitioner’s involvement in the murder.

Summary

The petitioner, Ankit Kumar, sought anticipatory bail after learning that he might be arrested in a murder case (PS Digha Case No. 866 of 2024) involving the killing of a young man. The FIR alleged that the victim was shot during a robbery, and during investigation a co-accused, Sanjeev Kumar, gave a confessional statement implicating the petitioner and another accused, Nitish Kumar, in the murder. The petitioner argued that he was not named in the FIR, has a clean antecedent, and is innocent of the offences listed under Sections 309(6), 103(1), 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act. The State opposed the bail, emphasizing the seriousness of the charges and the confessional statement. The Court, after considering the nature of the accusation and the co-accused’s statement, refused the anticipatory bail application.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in view of the confessional statement of a co-accused
  • Whether the petitioner’s non-mention in the FIR and clean antecedent are sufficient grounds for bail
