BAIL GRANTED

Holding

The court granted regular bail to the petitioner, holding that the circumstances did not justify continued detention.

Summary

The petitioner, Raushan Kumar, was arrested in connection with a case registered under sections 126(2), 109, 351, 352 and 3(5) of the B.N.S., 2023 and section 27 of the Arms Act for allegedly firing upon the victim, resulting in two simple lacerated wounds. He had been in custody since 30‑03‑2025 and applied for regular bail. The court examined the nature of the injuries, the seriousness of the offences, and the fact that the wounds were simple, concluding that the circumstances did not warrant continued detention. Accordingly, the court allowed the bail application, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties of the same amount. The bail was to be released upon satisfaction of the Chief Judicial Magistrate, Vaishali.
