Anil Kumar RamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The bail application is allowed and the petitioner is released on bail.

Summary

The petitioner, Anil Kumar Ram, was arrested in connection with S.T. No. 295 of 2025 for alleged dowry death under Sections 80 and 3(5) of the Bharatiya Nyaya Sanhita. The prosecution alleged that the petitioner and co‑accused killed the informant's daughter for dowry, while the petitioner claimed innocence, stating the deceased committed suicide and that he had no dowry demand. He had been in custody since 19 May 2025 and the charge was framed on 4 November 2025. The State opposed bail, but the court considered the nature of the accusation, the period of custody, and the fact that charges had been framed. The court allowed the bail application, directing release on a bail bond of Rs. 10,000 with two sureties, subject to the satisfaction of the District & Additional Sessions Judge, Buxar.

Issues considered

  • Whether bail should be granted to the petitioner under Sections 80 and 3(5) of the Bharatiya Nyaya Sanhita in a dowry‑death case.
  • Whether the petitioner’s alleged involvement in the death warrants continued detention.

                   A.P.P. for the State.

                                2. Petitioner seeks regular bail in connection with S.T.

No. 295 of 2025 arising out of Rajpur P. S. Case No. 170 of

2025 in a case registered for the offences punishable under

Sections 80, 3(5) of the Bharatiya Nyaya Sanhita.

                                3. As per prosecution case, all the F.I.R. named

accused persons, including this petitioner, killed the daughter of

informant due to non-fulfillment of demand of dowry.

                                4. Learned counsel for the petitioner submits that

petitioner is innocent and has falsely been implicated in this

case merely because he is husband of the deceased. Petitioner

never demanded any dowry nor harassed the deceased. As a

matter of fact, deceased herself committed suicide. Petitioner

                        opposed the bail application.

                                     6. Considering the nature of accusation, period of

custody and the fact that charge has been framed against the

petitioner, this bail application is allowed. The petitioner, above
