Patna High Court

Manisha DeviversusPankaj Kumar Jha @ Lal Jha

Decided
Disposal
DISMISSED

Holding

Section 403 of the BNSS bars alteration of a final judgment, so the application for modification is dismissed.

Summary

Manisha Devi and Anuja filed an application seeking modification of a final judgment dated 28 July 2025 against Pankaj Kumar Jha and the State of Bihar. The court examined whether, under Section 403 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), a final judgment can be altered. It held that the specific provision expressly prohibits any alteration of a final order. Consequently, the court found no merit in the petition for modification. The application was therefore rejected.
