Holding

The court held that provisional anticipatory bail may be granted subject to conditions and verification of the petitioner’s antecedent.

Summary

The petitioner, Kara Ray, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act concerning alleged recovery of 10 litres of liquor. The petitioner argued that he was not caught in possession, the alleged liquor was recovered from a place not belonging to him, and the case relied on a confessional statement of Nageshwar made in police custody, which he claimed lacked evidentiary value. The State opposed the bail, contending the seriousness of the offence. The High Court, after considering the submissions, granted provisional anticipatory bail subject to a Rs.10,000 bond, two sureties, and verification of the petitioner’s criminal antecedent under Section 482(2) of the CrPC. The order stipulated that if more than two prior cases are found, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Excise Act where the alleged contraband was not recovered from the petitioner’s possession.
  • Whether a confessional statement made by a co‑accused in police custody can form the basis for denying anticipatory bail.
  • Whether the petitioner’s prior criminal antecedent of two cases affects the grant of anticipatory bail.
