BAIL REJECTED

Holding

Anticipatory bail was denied as the petitioner’s alleged involvement was established by the investigation.

Summary

The petitioner, Sanjay Kamat, applied for anticipatory bail fearing arrest in a case (Supaul P.S. Case No. 291 of 2025) registered under Section 303(2) of the Bharatiya Nyaya Sanhita for allegedly stealing a bag containing ornaments worth ten lakh rupees and cash. The prosecution’s informant alleged that the petitioner planned and executed the theft, a claim supported by confessional statements of co‑accused who implicated him as the mastermind and the one who actually snatched the bag. The High Court examined the material on record, including the investigation report and the confessional statements, and found that the petitioner’s alleged involvement was substantiated. Consequently, the Court held that no relief could be granted in view of the serious nature of the allegations. The anticipatory bail application was therefore rejected.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the Criminal Procedure Code in view of the allegations and confessional statements implicating him in the offence under Section 303(2) of the Bharatiya Nyaya Sanhita.
