Patna High Court

Manoj RamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court inclined to grant bail to the petitioner, subject to monetary and procedural conditions.

Summary

Manoj Ram was arrested in connection with a dispute over dirty wastewater, alleged to have assaulted the informant and his family with weapons, leading to grievous injuries. The FIR lists offences under IPC sections 341, 323, 324, 325, 354B, 447, 504, 506, 34 and later added section 307 (attempt to murder). The petitioner argued that he was falsely implicated, that the allegations were vague, he has no prior criminal record, and has been in custody since 27 July 2025. The State and the informant opposed bail, citing the seriousness of the charges. The High Court, after considering the facts, the period of custody, and the lack of antecedents, granted bail subject to a cash bond of Rs. 15,000, two sureties, and conditions regarding appearance, non‑tampering with evidence, and non‑intimidation of witnesses.

Issues considered

  • Whether bail should be granted to the accused in a case involving multiple offences including attempt to murder under Section 307 IPC.
  • Whether the petitioner’s claim of false implication and lack of specific overt acts warrants bail.
