Patna High Court

Ranjan chaudharyversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a Rs.10,000 bond, two sureties, and conditions under Section 482 of the BNSS and Section 438(2) of the CrPC.

Summary

The petitioner, Ranjan Chaudhary, a landlord, faced an arrest threat in connection with a case filed by his tenant alleging assault on the tenant's husband. The petitioner contended that the injury was minor and that the complaint was motivated by a rent dispute, as the tenant operated a medical shop in the landlord's house. He applied for bail, arguing that the nature of the alleged offence and the simple injury did not justify detention. The court, considering these facts, allowed the bail application, directing release upon furnishing a bail bond of Rs.10,000 with two sureties of equal amount, subject to conditions under Section 482 of the BNSS and Section 438(2) of the CrPC. Consequently, the petitioner was ordered to be released on bail if arrested or surrendered within six weeks.
