BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

Mantu Kumar applied for regular bail under section 310(2) of the Bhartiya Nyaya Sanhita, 2023, in a case where five to six unknown persons allegedly looted ornaments worth about Rs. 2 lakh from an informant’s house. The prosecution’s case is based on a co‑accused’s statement that falsely implicated the petitioner; no incriminating article was recovered from him and he was not subjected to a TI‑parade despite being in custody since 31‑July‑2025. The trial court report indicated that the case is still gathering prosecution evidence and bailable warrants have been issued for witnesses. Considering the lack of material evidence against the petitioner and the prolonged pre‑trial detention, the High Court ordered his release on bail upon furnishing a bond of Rs. 10,000 with two sureties. The bail order was directed to be satisfied before the Additional Chief Judicial Magistrate‑I, Patna.

Issues considered

  • Whether regular bail should be granted to the petitioner under section 310(2) of the Bhartiya Nyaya Sanhita given the absence of incriminating material and the prolonged pre‑trial custody.
