The Court granted regular bail to the petitioner.

Summary

Petitioner Rajeev Kumar was charged under Sections 191(2), 190, 329(3), 115(2) and 109 of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act for allegedly firing at the husband of an informant during a shooting incident. The prosecution alleged that both Rohit Mandan and the petitioner fired, but the medical report indicated only simple injuries to the victim. The petitioner’s counsel argued that there was no direct allegation that the petitioner fired and that the injuries were minor, and highlighted that the petitioner had been in judicial custody since 25 July 2025. The informant opposed bail, citing the petitioner’s prior criminal case. After hearing both sides, the High Court found the lack of direct evidence and the simple nature of the injuries sufficient to grant regular bail, subject to a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail despite charges under serious offences including attempted murder and the Arms Act
  • Whether the absence of a direct allegation of the petitioner firing and the nature of the injuries justify bail
