Provisional anticipatory bail is granted subject to bond, sureties and verification of the petitioner’s antecedent, with confirmation contingent on the antecedent not exceeding four cases.

Summary

The petitioner, Om Prakash Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act concerning alleged recovery of 40.310 litres of liquor from a public pond area. He argued that the liquor was not found in his possession and the location did not belong to him, and highlighted his prior four excise cases. The State opposed the bail. The Court granted provisional anticipatory bail conditioned on a Rs.20,000 bond with two sureties and directed verification of his criminal antecedent. If more than four prior cases are found, the bail will not be confirmed; if only four, the provisional order will be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in an excise case where the alleged contraband was not seized from his possession
  • Whether the petitioner’s prior criminal antecedent of four excise cases affects the grant of anticipatory bail
