DISPOSED

Holding

The application for modification is disposed of as no alteration of the earlier order or police action is required.

Summary

The petitioner, Ranjeet Singh, an informant in a 2009 police case, filed a modification application to alter the order dated 30‑08‑2025 in Criminal Miscellaneous No.3015 of 2024 so that he could participate in mediation. He asserted his readiness to appear before the mediator and noted that the opposite party had also agreed to settle the monetary dispute of Rs 8,55,000, having already paid Rs 1,40,000. The court examined whether any modification of the earlier order or any action by the Superintendent of Police was required. Finding that the matter had already been referred to the district court mediator and that the parties intended to appear before the mediator on 27‑02‑2026, the court held no modification was necessary. Accordingly, the court directed the petitioner to file attendance on 07‑02‑2026 and disposed of the modification application, leaving the original order intact and directing the parties to resolve the dispute through mediation.

                                       ORAL ORDER

5 30-01-2026 Heard learned counsel appearing on behalf of the

petitioner; learned APP for the State and learned counsel for the

opposite party nos. 2 and 3.

                                 2. Mr. Durgesh Kumar Singh, learned counsel

appearing on behalf of the petitioner (informant of

Shrikrishnapuri P.S. Case No. 35 of 2009) informs that the

petitioner/informant has now knowledge about the order dated

30.08.2025 passed in Cr. Misc. No. 3015 of 2024 and to comply

with the order, as well as, to buy peace of mind, the

informant/petitioner is ready to participate in the mediation and

will appear before the learned Mediator as and when required.

He further submitted that the O.P. No.2 (petitioner of Cr. Misc.

No. 3015 of 2024) has also admitted that the dispute in respect

of money transaction can be resolved amicably outside the court

and he is only required to return a sum of Rs. 8,55,000/- as the

informant has received Rs.1,40,000/- before the order dated

          30.08.2025 was passed.

                       3. As the informant (petitioner) has already appeared

before this Court and he is ready to resolve the dispute by way

of mediation, I don’t find that the order dated 30.08.2025 is

required to be modified in any manner or the Superintendent of

Police is required to take any action against the petitioner /

          informant.

                       4. Today also, respective parties upon instruction have

jointly informed this Court that as the matter has already been

referred to the concerned Mediator of the learned District Court,

they will appear before the learned Mediator on 27.02.2026 for

amicable settlement of dispute between the parties, but before

that Mr. Durgesh Kumar Singh, learned counsel appearing on

behalf of the informant / petitioner finds it proper that the

informant / petitioner will appear in person or shall appear

through his counsel on 07.02.2026 by filing attendance so that

finally the dispute can be resolved on 27.02.2026 or any other

date agreed upon between the parties.

                                 5. Accordingly, the present modification application

                    stands disposed of.
