Patna High Court

Raja PaswanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to conditions under Section 480(3) of the B.N.S.S.

Summary

The petitioner, Raja Paswan, was charged under Sections 137(2) and 96 read with Section 3(5) of the B.N.S., 2023 for alleged kidnapping of the minor daughter of an informant. The petitioner claimed innocence, stating the incident was a consensual love affair and that the girl voluntarily traveled to Chennai by bus and later returned, as recorded under Sections 180 and 183 of the B.N.S.S. The State opposed bail, noting the victim's refusal to undergo a medical examination. The court considered the victim's voluntary conduct, the petitioner’s clean antecedent, the filing of the chargesheet, and his period of custody. Accordingly, the court granted bail on a Rs.10,000 bond with two sureties and imposed conditions under Section 480(3) of the B.N.S.S.

Issues considered

  • Whether bail should be granted to the accused in a kidnapping case where the alleged victim claims the act was voluntary.
  • Whether the refusal of the victim to undergo a medical examination affects the bail decision.
  • Whether the petitioner’s clean antecedent and the filing of the chargesheet justify bail.
