Holding

The Court granted anticipatory bail to petitioners No.1 and 3‑5, subject to conditions under Section 482(2) of the BNSS.

Summary

The petitioners, five residents of Sabalpur village, feared arrest in a case registered under multiple sections of the Bihar Negotiable Sale (BNSS) relating to alleged illegal sand mining and assault on police. They claimed they were falsely implicated, stating that the tractor involved belonged to petitioner No.1 and was merely parked when police arrived. The informant alleged that unknown accused assaulted the police, but the petitioners argued the specific assault allegation pertained only to petitioner No.2, whose anticipatory bail application was withdrawn. The State opposed granting anticipatory bail to the remaining petitioners. Considering the submissions, the Court ordered that petitioners No.1 and 3‑5 be released on anticipatory bail, subject to a bail bond of Rs.10,000 and two sureties each, under Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail should be granted to petitioners No.1 and 3‑5 despite the serious charges under the BNSS.
  • Whether the allegations against the petitioners constitute sufficient ground to deny anticipatory bail.
  • Effect of the withdrawal of petitioner No.2's anticipatory bail application on the remaining petitioners.

Subjects

  • anticipatory bail
  • false implication
  • illegal sand mining
  • police assault
  • Section 482
  • bail conditions
  • withdrawal of application
