The court granted bail to the petitioner on the condition of a Rs 10,000 bond with two sureties.

Summary

Sonu Kumar Sone was arrested in connection with a case (Salimpur P.S. Case No. 271 of 2025) alleging that he, along with co‑accused, seized an informant's tempo and mobile phone at gunpoint, offences punishable under Sections 310(2) and 111(2) of the B.N.S., 2023. The petitioner claimed he was falsely implicated, stating that the FIR was lodged against unknown miscreants and that a co‑accused, Satish Kumar, had given a confessional statement naming him, yet nothing was recovered from the petitioner’s possession. He highlighted that Satish Kumar had already been granted bail in a similar case and that he had been in judicial custody since 1 October 2025. The State opposed bail, citing four prior criminal cases against the petitioner. After hearing both sides, the court found the circumstances sufficient to grant bail, ordering the petitioner to furnish a bail bond of Rs 10,000 with two sureties.

Issues considered

  • Whether bail should be granted to the petitioner in a case involving offences under Sections 310(2) and 111(2) of the B.N.S., 2023 despite alleged involvement and prior criminal antecedents.
  • Whether the confessional statement of a co‑accused and the lack of material recovered from the petitioner justify denial of bail.
