Holding

The court granted bail to the petitioner subject to a cash bond, sureties and attendance conditions.

Summary

Rahul Kumar was arrested in connection with a case registered under Section 303(2) of the B.N.S., 2023 for the alleged theft of a bike. The petitioner claimed innocence, stating that the only reference to him was in the confessional statement of a co‑accused and that no material was recovered from his possession. The State opposed bail, highlighting seven prior criminal cases against the petitioner. The court examined the lack of direct evidence, the petitioner’s cooperation, and his right to liberty, and decided to grant bail with strict conditions, including a bond of Rs.10,000, two sureties, and mandatory attendance before the trial court. The bail may be cancelled if the petitioner fails to comply with the conditions.

Issues considered

  • Whether bail should be granted to the petitioner under Section 303(2) of the B.N.S., 2023 despite his criminal antecedents
  • Whether the evidence, limited to a co‑accused’s confessional statement, justifies denial of bail
