Anita KumariversusThe State of Bihar

Decided

BAIL GRANTED

Holding

The court granted bail to the petitioners subject to the stipulated conditions.

Summary

Anita Kumari and Shibu Choudhary filed a bail petition fearing arrest in a case registered under Sections 103(1), 238 and 3(5) of the Bhartiya Nyaya Sanhita for alleged murder of a relative. The informant, who is not an eye‑witness, claimed the petitioners killed his nephew and left the body on a railway track, but the petitioners contended the deceased fell from a train and died of accidental injuries as shown in the post‑mortem report. They argued the case was fabricated to facilitate a land grab and that no witness had seen them commit the alleged act, emphasizing their clean antecedent. The State opposed bail. The court, after considering the facts, ordered that the petitioners be released on bail if they surrender within eight weeks, upon furnishing a bail bond of Rs 10,000 each with two sureties, subject to conditions under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Issues considered

  • Whether bail should be granted to the petitioners despite the serious nature of the alleged offences
  • Whether the allegations constitute a fabricated case aimed at land acquisition
  • Whether the conditions of Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023, justify granting bail
