Holding

The court inclined to enlarge the petitioners on bail and granted regular bail to both petitioners.

Summary

The petitioners, Goldi Kumari and Anshu Kumari, were arrested following a police raid on a house in Sasaram where a male and two females were found in a compromising position and the petitioners were later discovered. They were charged with offences under various sections of the Bihar Narcotic Substances Act, the Immoral Trafficking Act, the POCSO Act and the Juvenile Justice Act. The petitioners contended that they were innocent, had no specific allegations against them, the victims said they were not forced, and they had no prior criminal record, having been in custody since 12 September 2025. The State opposed the grant of regular bail. The High Court, noting the lack of specific incriminating material and the fact that similarly situated co‑accused had been granted bail, ordered that the petitioners be released on regular bail upon furnishing a bond of Rs 10,000 each with two sureties.

Issues considered

  • Whether regular bail should be granted to the petitioners accused under sections 143(1), 143(5), 144(1), 144(2), 64(1), 111, 61(2) of the B.N.S., sections 3‑7 of the Immoral Trafficking Act, sections 4 & 8 of the POCSO Act and sections 75 & 79 of the Juvenile Justice Act.
