Patna High Court

Mangana Roy @ Mangan RoyversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Bail is denied as there is no new ground and the trial is at an advanced stage.

Summary

Mangana Roy was arrested in connection with a case registered under multiple sections of the Indian Penal Code, including 341, 323, 325, 307, 379, 504, 506, 34 and later 302. He applied for regular bail, having been in judicial custody since 8 October 2024, and this was his second bail application after an earlier rejection. The court noted that only three of nine charge‑sheet witnesses had been examined and that the trial was expected to conclude within three months. The petitioner argued lack of criminal antecedents and undue delay, while the State opposed bail. Finding no new ground for relief and observing that the trial was at an advanced stage, the court denied bail, directing the lower court to expedite the trial and allowing a fresh bail application if the trial exceeds three months.

Issues considered

  • Whether bail should be granted to the petitioner at the present stage of trial
  • Whether any new ground exists to revisit the earlier bail denial

3 06-02-2026 Heard learned counsel for the petitioner and

                   learned APP for the State.

                           2. The petitioner seeks bail in connection with Baliya

Belon P.S. Case No. 36 of 2024, instituted for the offences under

                   Sections 341, 323, 325, 307, 379, 504, 506, 34 of the Indian

Penal Code and later on added Section 302 of the Indian Penal

                   Code.

                           3. This is the second attempt of the petitioner for bail.

The petitioner has renewed his prayer for grant of regular bail

which was earlier rejected by this Court vide order dated

12.09.2025 passed in Cr. Misc. No. 49199 of 2025 taking into

account the direct allegation of giving knife blow against the

                   petitioner.

                           4. In compliance of the order dated 11.11.2025, a

report dated 17.11.2025 with regard to the present stage of trial
Patna High Court CR. MISC. No.76957 of 2025(3) dt.06-02-2026
                                                         2/2

has been received. From perusal of the aforesaid report, it

appears that out of nine charge-sheeted witnesses, only three

witnesses have been examined in this case. It is further reported

that the trial is likely to be concluded within a period of three

                       months.

                               5. Learned counsel for the petitioner submits that the

petitioner is languishing in judicial custody since 08.10.2024

without any rhymes or reason and has got no criminal

                       antecedent.

                               6. Learned APP for the State has vehemently opposed

the prayer for grant of bail to the petitioner.

                               7. There is no new ground to consider the bail petition

of the petitioner. From the aforesaid report, it appears that the

trial is going on and is at an advance stage.

                               8. In view of the above, the prayer for bail of the

petitioner is again rejected with a direction to the court below to

expedite the trial and conclude the same. However, if the trial is

not concluded within the period of three months, the petitioner

will be at liberty to renew his prayer before the court below.

                                                                   (Rudra Prakash Mishra, J)
