Decided
Disposal
BAIL GRANTED

Holding

The Court grants bail to the petitioner.

Summary

The petitioner, Raja Manjhi, was arrested in connection with a case alleging assault on an informant and her daughter‑in‑law, involving the use of an iron rod and bricks, under several sections of the Bharatiya Nyaya Sanhita, 2023. The prosecution alleged that the offences occurred on 6 August 2025, while the petitioner contended that he was falsely implicated, that the allegations were vague, the injuries were minor, and he had no prior criminal record. The petitioner had been in custody since 11 September 2025 and sought bail. The State opposed the bail application. After considering the nature of the alleged offences, the period of custody, the lack of specific overt acts, and the petitioner’s clean antecedent, the Court decided to grant bail. The bail was conditioned on a bond of Rs.15,000 and two sureties of the same amount.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the offences alleged under the Bharatiya Nyaya Sanhita, 2023.
