Patna High Court

Satyendra BindversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail should be granted as there is no direct allegation against the petitioner and he has already spent a considerable period in custody.

Summary

The petitioner, Satyendra Bind, was arrested in connection with an alleged assault on 21 August 2025, where a co‑accused allegedly struck the victim and stole Rs.10,000. The charge sheet includes offences under Sections 126(2), 115(2), 303(2), 109, 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The petitioner contended that he was falsely implicated, that no specific overt act was alleged against him, and that he has no prior criminal record, having been in custody since 31 August 2025. The State opposed bail, arguing the seriousness of the offences. Considering the absence of a direct allegation of assault against the petitioner and the period of custody already served, the Court granted bail on the condition of a Rs.15,000 bond with two sureties.
