BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to a bail bond of Rs 10,000, two sureties and compliance with Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The Patna High Court entertained an anticipatory bail application filed by Chanchala Devi, who feared arrest in a criminal case registered under Sections 126(2), 115(2), 303(2), 109(2) and 3(5) of the Bharatiya Nyaya Sanhita for alleged assault and mobile‑phone snatching. The FIR alleged that the accused, including the petitioner, assaulted the informant’s nephew and seized his phone, but the petitioner asserted she had no role, the allegation was vague, the injury was minor and she possessed a clean antecedent. She further highlighted that co‑accused persons had earlier been granted anticipatory bail in a similar matter. The State opposed the bail. Weighing the nature of the accusation, the minor injury, the petitioner’s clean record and the precedent of bail to co‑accused, the Court allowed anticipatory bail, directing that if arrested within eight weeks she be released on a bail bond of Rs 10,000 with two sureties, subject to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the facts of the case
  • Whether the allegations in the FIR constitute a specific cognizable offence justifying arrest
  • Whether conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 are applicable
