Patna High Court

Rajendra SahaniversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner subject to bond and conditions.

Summary

Petitioner Rajendra Sahani was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly possessing 250 litres of country‑made liquor concealed in paddy straw. The prosecution alleged that the liquor was recovered from a public area and that the petitioner’s name was identified by a local chowkidar. The petitioner contended that no incriminating material was found in his possession, he was falsely implicated, and the recovery was from an open place; he also highlighted the lack of compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. Despite three prior criminal antecedents and having been in custody since 7 December 2025, the State opposed bail. The High Court, after considering the circumstances and the procedural lapse, granted bail on the condition of a Rs 15,000 bond with two sureties and imposed standard bail conditions regarding appearance, non‑tampering with evidence, and non‑intimidation of witnesses.

Issues considered

  • Whether bail should be granted to the accused in a case under Section 30(a) of the Bihar Prohibition and Excise Act considering the facts of recovery and the accused’s antecedents.
  • Whether the non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, warrants denial of bail.
