Prince KumarversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was refused.

Summary

The petitioner, Prince Kumar, sought anticipatory bail in a criminal miscellaneous case (No. 7745 of 2026) arising from PS Hilsa Case No. 549 of 2024. The prosecution alleged that he forcibly entered an informant's house, attempted rape, and assaulted the informant's husband, invoking several sections of the Bharatiya Nyaya Sanhita. The petitioner pleaded innocence, asserted a clean antecedent, and argued that the allegations did not merit pre‑emptive release. The learned counsel for the State opposed the bail, emphasizing the seriousness of the charges. After hearing both sides, the Court examined whether the criteria for anticipatory bail under the Bharatiya Nyaya Sanhita were satisfied. The Court concluded that the nature of the accusations warranted denial of anticipatory bail and refused the petition.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the Bharatiya Nyaya Sanhita in view of the alleged offences.
