Patna High Court

Shiv Kumar KewatversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to regular bail and is directed to be released on furnishing the prescribed bond and sureties.

Summary

Shiv Kumar Kewat, a driver‑cum‑owner of a vehicle allegedly used in the kidnapping of a woman, was arrested on 27‑08‑2025 and charged under Sections 140(1), 140(3) and 3(5) of the BNS. He applied for regular bail, contending he has a clean record and that the victim’s husband and a co‑accused had earlier been granted bail in related matters. The State opposed the bail, arguing the victim’s statement under Section 183 BNSS supported the prosecution. The Court considered the earlier bail orders and the petitioner’s circumstances, and ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties. The bail was directed to be granted to the trial court where the case is pending.

Issues considered

  • Whether the petitioner is entitled to regular bail under Sections 140(1), 140(3) and 3(5) of the BNS despite the victim’s statement under Section 183 BNSS.
  • Whether the earlier bail orders for the victim’s husband and a co‑accused influence the petitioner’s bail application.
