The court granted provisional anticipatory bail to the petitioner, subject to a bail bond, sureties, and verification of his antecedent.
Summary
The petitioner, Amit Kumar, was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2018 for allegedly recovering 279 litres of liquor from a location near the Kai river. He argued that he has a clean antecedent, was not arrested, and that the alleged recovery was from a public area, with the complaint filed by a hostile watchman. The State opposed his anticipatory bail application. The High Court, considering these submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing a bail bond of Rs.500 with two sureties, subject to verification of his criminal antecedent under Section 482(2) of the B.N.S.S. The order was conditioned that if any antecedent is found, the bail would not be confirmed; otherwise, it would be confirmed. The court also required the petitioner to deposit Rs.1500 with the Advocates’ Association, Patna High Court.
Issues considered
- Whether anticipatory bail should be granted when the petitioner claims no arrest, no possession, and a clean antecedent.
- Whether the allegations based on a hostile watchman's testimony are sufficient to deny anticipatory bail.
- What conditions may be imposed under Section 482(2) of the B.N.S.S. for provisional anticipatory bail.
