Patna High Court

Pawan Kumar Purve @ Pawan Kumar PurveyversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner is entitled to regular bail subject to a bail bond, sureties and specified conditions.

Summary

The petitioner, Pawan Kumar Purve, was arrested in connection with a cyber‑PS case alleging forgery of fishing IDs, unlawful alteration of Aadhaar details and illegal collection of personal documents while operating a Common Service Center. He faced charges under several sections of the Bihar Negotiable Securities Act, the Information Technology Act and the Aadhaar Act. The petitioner, represented by senior counsel, argued that a co‑accused had been granted bail and that he had no similar criminal antecedents, having been in custody since 31‑07‑2025. The court considered these facts and, applying the principles of regular bail, ordered his release on a bail bond of Rs 10,000 with two sureties, subject to conditions of cooperation, non‑involvement in crime and verification of any other criminal antecedents. The order expressly limited its effect to the bail application and did not prejudice the trial court’s independent assessment of the merits.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the seriousness of the offences under the BNS, IT Act and Aadhaar Act
  • Whether the bail granted to a co‑accused influences the petitioner’s bail application
  • Whether the conditions imposed are sufficient to justify the grant of bail
