The Court grants bail to the petitioner subject to a bond of Rs 15,000, two sureties, and conditions of family surety and mandatory appearance at each trial date.
Summary
The petitioner, Shahansa, was arrested in connection with a Pothia police case alleging assault on the husband of an informant using an iron rod, under Sections 126(2), 115(2), 117(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The prosecution contended that Shahansa, along with co‑accused, inflicted serious injuries, while the petitioner claimed innocence, stating no incriminating material was found in his possession and that he has no prior criminal record. The petitioner had been in custody since 12‑08‑2025, whereas a co‑accused had already been granted bail. The State opposed the bail application, emphasizing the gravity of the offences. After considering the facts, the period of custody already served, and the petitioner’s clean antecedent, the Court inclined to grant bail, imposing a bond of Rs 15,000 with two sureties and conditions of family surety and regular appearance in court.
Issues considered
- Whether bail should be granted to the petitioner accused of offences under the Bharatiya Nyaya Sanhita, 2023, considering the seriousness of the alleged assault and the period of custody already undergone.
