Patna High Court

Sanoj Das @ Sanoj KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a bond and conditions under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Summary

The petitioner, Sanoj Das, was arrested in connection with a FIR alleging that he assaulted the husband of an informant and placed a pistol in his mouth, causing a simple injury. He sought bail, claiming a clean antecedent. The State opposed bail, citing the seriousness of the offences listed under sections 115(2), 126(2), 109, 352, 351(2), 351(3) and 3(5) of the Bharatiya Nagarik Suraksha Sanhita. The court considered the nature of the injury, the petitioner’s clean record, and other circumstances, and decided that bail could be granted provided a bond of Rs.10,000 with two sureties and subject to conditions under section 482(2) of the BNS. Consequently, the petitioner was released on bail.

Issues considered

  • Whether bail should be granted to the petitioner despite the seriousness of the offences alleged under the BNS.
  • Whether the petitioner’s clean antecedent and the simple nature of the injury justify bail under section 482(2) of the BNS.
