Holding

The Court granted provisional anticipatory bail to the petitioner subject to bond, sureties, and verification of his criminal antecedent.

Summary

The petitioner, Sudhanshu Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act concerning the alleged recovery of 2,070 litres of liquor from a truck. He contended that he was not in possession of the liquor, was not the owner of the vehicle, and was implicated solely on the basis of a confessional statement made by another accused in police custody, which he argued lacked evidentiary value. The State opposed the bail, citing the seriousness of the excise offence and the petitioner’s alleged prior involvement in ten similar cases. The High Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bond of Rs. 50,000 with two sureties and directed verification of the petitioner’s criminal antecedent. The order further stipulated that if the petitioner is found to have more than ten prior cases, the bail would be cancelled, otherwise the provisional bail would be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the confessional statement of another accused can form a basis for implicating the petitioner.
  • Whether the petitioner’s prior criminal antecedent of ten cases affects the grant of anticipatory bail.
