Patna High Court

Ram Balak RamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a bond and sureties under section 482(2) of the BNS.

Summary

Ram Balak Ram, the father‑in‑law of a woman who died in a dowry‑death case, filed a bail petition after being implicated under sections 80, 238 and 3(5) of the Bharatiya Nagarik Suraksha Sanhita (BNS). The prosecution alleged that he, along with other accused, tortured the victim for dowry and participated in her killing. The petitioner argued that he had no involvement in the marital affairs, maintained a clean antecedent, and was merely a victim of over‑implication. The State opposed bail. The court, noting the petitioner’s clean record and the circumstances, ordered bail on a bond of Rs.10,000 with two sureties, subject to the conditions of section 482(2) of the BNS. The bail order was conditioned on surrender or arrest within eight weeks.

Issues considered

  • Whether the petitioner is entitled to bail despite being charged under sections 80, 238 and 3(5) of the BNS in a dowry‑death case
  • Whether the conditions of section 482(2) of the BNS justify granting bail
