Patna High Court

Anand KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that anticipatory bail may be granted under Section 482 of the B.N.S.S., 2023 when the petitioner is subject only to a general allegation and not a specific charge, subject to reasonable conditions.

Summary

Anand Kumar's anticipatory bail petition was earlier dismissed as withdrawn. The remaining petitioner, Rajendra Mahto, filed an anticipatory bail application fearing arrest in a case registered under multiple sections of the B.N.S., 2023, alleging assault on the informant's sons. The FIR specifically charges other co-accused, while the allegation against Rajendra Mahto is general and omnibus. The State opposed the bail, but the court noted the lack of a specific charge against the petitioner. Applying Section 482 of the B.N.S.S., 2023, the court granted anticipatory bail on the condition of furnishing a bail bond of Rs.10,000 with two sureties and surrender within eight weeks. The application was disposed of accordingly.

Issues considered

  • Whether anticipatory bail can be granted under Section 482 of the B.N.S.S., 2023 to a person facing multiple offences with only a general allegation.
  • Whether the general and omnibus nature of the accusation against the petitioner justifies the grant of bail.
  • Whether the conditions imposed for bail are appropriate and sufficient.
