Patna High Court

Doman RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner subject to a bond of Rs.15,000 and two sureties of the same amount.

Summary

The petitioner, Doman Rai, was arrested on 12-12-2025 for alleged possession of 75 litres of country-made liquor recovered from a public place, under Section 30(a) of the Bihar Prohibition and Excise Act. He contended that no incriminating material was found in his conscious possession and that he was falsely implicated, also noting a lack of compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed the bail application, citing the offence and the petitioner’s prior criminal antecedent. The Court considered the facts, the period of custody, and the absence of direct evidence against the petitioner. Consequently, the Court granted bail on the condition of a Rs.15,000 bond and two sureties of equal amount.

Issues considered

  • Whether bail should be granted to the accused in a case under Section 30(a) of the Bihar Prohibition and Excise Act considering the nature of the offence, custody period, and lack of material in possession.
