The court granted anticipatory bail to the petitioner, subject to bond, sureties, and conditions under Section 482(2) of the CrPC.

Summary

The petitioner, Raja Kumar Verma, sought anticipatory bail in a case (Thakraha P.S. Case No. 78 of 2024) where he was alleged to have participated in molestation and assault with a knife, leading to injuries to three persons. The prosecution charged him under Sections 126(2), 115(2), 118(1), 109, 324(2) and 3(5) of the B.N.S.S. The petitioner contended that the allegations were false, that the injuries were minor, and that he had no criminal record. The State opposed the bail, arguing the seriousness of the offences. After considering the submissions, the court ordered that the petitioner be released on bail if arrested or surrendered within six weeks, subject to a bond of Rs.10,000 and two sureties, and conditions under Section 482(2) of the CrPC. The order effectively granted anticipatory bail with specified safeguards.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite serious charges of molestation and assault.
  • Whether the petitioner is likely to flee, tamper with evidence, or influence witnesses.
  • Whether the allegations against the petitioner are credible or constitute a false case.
