Patna High Court

Ravikant Kumar @ Chhotu SharmaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to specified conditions.

Summary

The petitioner, Ravikant Kumar, was arrested in connection with a case involving a stolen car and charged under Sections 317(5), 318(4), 111(3), 336(3) and 3(5) of the B.N.S., 2023. He claimed innocence, alleging false implication, and pointed out that co‑accused had already been released on bail by the same court. He had been in custody since 17 May 2025 and had seven other pending cases but had not previously applied for anticipatory or regular bail. The State opposed the bail application. The High Court, after considering the facts, the bail granted to co‑accused, and the petitioner’s willingness to cooperate, allowed the bail application, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties and imposing several conditions to ensure his availability and non‑interference with the investigation.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious charges under the B.N.S., 2023 and his prior criminal antecedents.
