Patna High Court

Ankit Singh @ Ankit KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a bond and sureties under Section 482(2) of the BNSS.

Summary

Ankit Singh was arrested in connection with a cyber‑offence (Sections 66(E), 67 and 67(B) of the Information Technology Act) for allegedly making a video of the informant’s daughter viral after befriending her on Instagram. The petition argued that the FIR did not allege any sexual harassment, none of the eight mobile numbers listed were linked to him, and the blackmail allegation was based merely on suspicion. The Additional Public Prosecutor contended that the allegations were specifically against the petitioner. The Court observed that the FIR lacked a concrete sexual assault allegation and that the mobile numbers did not prima facie connect to the petitioner, rendering the suspicion insufficient for continued detention. Accordingly, the Court granted bail on a bond of Rs. 10,000 with two sureties, subject to Section 482(2) of the BNSS, and ordered his release within four weeks of the order.

Issues considered

  • Whether bail should be granted when the FIR lacks a specific allegation of sexual harassment under the IT Act provisions.
  • Whether mere suspicion and unlinked mobile numbers justify continued detention of the accused.
