Patna High Court

PANKAJ THAKUR @ PANKAJ KUMARversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is appropriate and should be granted to the petitioner under the circumstances of the case.

Summary

Pankaj Thakur was arrested in connection with a case filed under Sections 126(2), 115(2), 118(1), 109(1), 352 and 351(1) of the Bharatiya Nyaya Sanhita, 2023, alleging that he and co‑accused assaulted an informant, causing simple injuries. The petitioner contended that he was falsely implicated, that no incriminating material was found in his possession, and that he had no prior criminal record. He also highlighted that a co‑accused had already been granted bail in a related matter. The State opposed the bail application, arguing the seriousness of the offences. The Court, after considering the length of the petitioner’s custody, the nature of the injury, the absence of material evidence, and the petitioner’s clean antecedent, decided to grant bail. Bail was ordered on a bond of Rs.15,000 with two sureties of the same amount.
