BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Pankaj Kumar, applied for regular bail in a case registered under sections 103(1), 64 and 238 of the B.N.S., 2023 concerning an alleged rape and death of a relative. His earlier bail application was withdrawn. The petitioner has been in custody since 2 July 2025. Counsel highlighted that the alleged incident occurred on 4 September 2024, but the complaint was filed on 16 December 2024 and the FIR was lodged only on 3 May 2025, indicating a delay. The court noted the informant’s wife’s statement that the death was due to illness and the lack of a post‑mortem. Considering these facts, the court allowed the bail application, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties and to cooperate with the trial.

Issues considered

  • Whether regular bail should be granted to the petitioner in a case under sections 103(1), 64 and 238 of the B.N.S., 2023 given the delay in filing the FIR and the circumstances of the death.
