Patna High Court

Manohar Kumar JhaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to surrender within eight weeks and compliance with the stipulated conditions.

Summary

The petitioner, Manohar Kumar Jha, sought bail after being implicated in an NDNDPS case involving the recovery of 600 litres of codeine syrup from a pick‑up van. Co‑accused identified him, but he asserted that he was neither the owner nor the driver of the vehicle and had no involvement in the seizure. He pleaded that the accusation was based solely on suspicion and highlighted his clean antecedent. The State opposed the bail application. The court, after considering the facts, ordered that bail be granted provided the petitioner surrenders within eight weeks, furnishes a bail bond of Rs 10,000 with two sureties of equal amount, and complies with conditions under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
