Decided

BAIL REJECTED

Holding

Anticipatory bail was denied to the petitioner.

Summary

Dashrath Yadav petitioned for anticipatory bail after an FIR alleged that he, along with others, assaulted an informant with lathis, danda, iron rods and fired indiscriminately, causing grievous injury. The FIR listed offences under several sections of the Bhartiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act. The petitioner also has six prior criminal convictions. The court examined whether the seriousness of the allegations, the nature of the injuries inflicted, and the petitioner’s criminal antecedents warranted the grant of anticipatory bail. Considering the violent nature of the alleged offences and the petitioner’s history, the court found no sufficient ground to grant bail. Consequently, the petition for anticipatory bail was rejected.
